Terms of Use
Last updated 18 October 2026
1. About these terms
This website is operated by Owen Magocha, a sole operator based in New South Wales, Australia (“I”, “me”, “my”). You can contact me through the contact form.
These terms apply when you visit the website, read or download anything from it, subscribe to the newsletter, buy a product, book a coaching session, enrol in a course, register for a live event or join the membership. By using the website or any of those offerings, you agree to these terms.
These terms should be read with:
- the Refund & Cancellation Policy, which explains refunds, cancellations and rescheduling; and
- the Privacy Policy, which explains how I handle your personal information.
If there is any inconsistency between these terms and the Refund & Cancellation Policy on a refund or cancellation question, the Refund & Cancellation Policy applies.
2. Your rights under the Australian Consumer Law
Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) or any other law that cannot lawfully be excluded, restricted or modified. This includes the consumer guarantees. Every other term in this document is subject to this clause.
3. What this website offers
The website currently offers, or may offer where stated on the relevant page:
- free articles, reflections and downloadable PDFs;
- a free email newsletter, The Sunday Reflection;
- paid digital products, such as ebooks, guided journals, workbooks and PDFs;
- printed books, where offered;
- personal and professional development coaching sessions and programmes;
- online courses in The Learning Room, both free and paid;
- free and ticketed live online events (Live Sessions);
- a membership, The Owen Magocha Circle;
- recommended reading, which may include affiliate links; and
- contact and “Get involved” forms.
Not every offering may be available at all times. I may add, change, pause or withdraw an offering. Doing so will not affect anything you have already paid for, except as set out in these terms or the Refund & Cancellation Policy.
4. Using the website
You may use the website for your own personal, non-commercial purposes. When using it, you must not:
- break any law or infringe anyone’s rights;
- attempt to gain unauthorised access to the website, its hosting, or any account or system connected to it;
- introduce viruses, malicious code, or anything that could harm the website or other users;
- use automated tools to scrape, copy or harvest content or personal information from the website;
- submit false, misleading, abusive, defamatory, harassing or offensive material through any form; or
- impersonate another person or misrepresent your connection with anyone.
I may refuse, remove or ignore any form submission, and may suspend or end your access to any part of the website (including a membership or course account) if you breach these terms. Where you have paid for something and I end your access because of a breach, the Refund & Cancellation Policy and the Australian Consumer Law will determine whether any refund is due.
I try to keep the website available and accurate, but I do not promise that it will always be available, uninterrupted or free from errors.
5. Intellectual property
Unless stated otherwise, I own or am licensed to use the copyright and other intellectual property in all content on the website and in my products. This includes text, articles, PDFs, ebooks, journals, workbooks, course materials, recordings, images, designs and the “Owen Magocha” name and logo. Content is protected by the Copyright Act 1968 (Cth) and other laws.
Free content. You may read, download, print and keep free articles and free PDFs for your own personal use. You may share a link to them, and quote short extracts with clear attribution to me and a link to the source. You must not republish them in full, sell them, or present them as your own.
Paid products, courses and member content. When you buy a product, enrol in a paid course or join the membership, I grant you a personal, non-exclusive, non-transferable licence to use the content for your own personal use. Unless I agree otherwise in writing, you must not:
- share, forward, upload or distribute the files, download links or login details;
- resell, sublicense or give away copies;
- use the content to teach, train or coach others commercially; or
- remove copyright notices or attribution.
Printing a copy of a journal or workbook for your own use is permitted.
Photographs and third-party material. Some images and materials belong to third parties and are used with permission or under licence. Those owners’ rights are not affected by these terms.
6. Purchases: general terms
These terms apply to everything you buy through the website.
Prices. Prices are in Australian dollars (AUD). Where GST applies, it is included in the price shown. I may change prices at any time, but a change will not affect an order already paid for.
Payment. Payments for digital products are processed by Stripe through Stripe Checkout. Coaching bookings are paid through Calendly using Stripe or PayPal. Membership payments are processed through Stripe Billing. Some event tickets may be sold through a third-party ticketing platform. I do not see or store your full card details; they are handled by the payment provider under its own terms and privacy policy.
Your contract with me. A contract for a purchase is formed when your payment is successfully completed. Where a purchase is made through a third-party platform, that platform’s terms may also apply to the payment or booking process, but I remain responsible for supplying the product or service you bought from me.
Receipts. Stripe emails your receipt to the email address you provide at checkout. Calendly and any ticketing platform send their own confirmation emails.
Accuracy. I take care to describe products accurately. Sample pages, images and descriptions are a guide to content and format. If I make an obvious pricing error, I may cancel the order and refund you in full before the product or service is supplied.
7. Digital products
Digital products (such as ebooks, guided journals, workbooks and PDFs) are delivered by a secure download link shown on screen after your payment is completed. The link is time-limited and expires 24 hours after it is issued; you can return to your order confirmation page for a fresh link, or contact me. Please download and save your files promptly.
If your link expires before you have been able to download the product, or a download fails, contact me through the contact form with your receipt details and I will send you a working copy.
You are responsible for having a device and software capable of opening the file format stated on the product page (for example, PDF).
8. Printed books (where offered)
Where I offer printed books:
- Sold through an external retailer. If a book is sold by a bookshop or online retailer, you buy it from that retailer. Its terms, delivery arrangements and returns policy apply to the sale, alongside your rights under the Australian Consumer Law.
- Sold and shipped by me. If I sell and ship a book directly, the product page will state the price, postage cost, delivery areas and estimated delivery time. Delivery times are estimates. Ownership and risk in the book pass to you on delivery. Refunds and replacements are covered by the Refund & Cancellation Policy.
9. Coaching
I offer personal and professional development coaching, including an Introductory 30-minute session, an Individual 60-minute session, a 3-session Development Package and a 6-week Structured Growth Programme. Sessions are held by online video call using the video-call platform named in your booking confirmation.
Booking and payment. Sessions are booked and paid for through Calendly. Your booking is confirmed once payment is completed and Calendly sends a confirmation.
Nature of coaching. Coaching is a structured conversation intended to help you reflect, clarify goals and plan action. It is not legal, immigration, financial, tax, medical, psychological, counselling or any other regulated professional advice, and must not be relied on as such. You remain responsible for your own decisions and their outcomes. I do not guarantee any particular result.
Separate from any professional practice. Although I am trained in law, coaching sessions booked through this website:
- do not create a lawyer–client relationship, a migration agent–client relationship, or any other professional advisory relationship with me or with any business I am involved in;
- will not include advice about your legal or immigration circumstances; and
- are not protected by legal professional privilege.
If you need legal or immigration advice, please consult an appropriately qualified professional.
Confidentiality. I keep what you share in coaching sessions confidential. I will not disclose it unless you agree, unless I am required or authorised by law to do so, or unless I reasonably believe disclosure is necessary to lessen or prevent a serious threat to someone’s life, health or safety.
Your participation. Please join on time from a private, reasonably quiet place with a stable internet connection. I do not record sessions unless we both agree beforehand.
Packages and programmes. Sessions in a package or programme must be used within the validity period stated in the Refund & Cancellation Policy.
Clients under 18. Coaching is offered to adults. I will only coach a person under 18 with the written consent of a parent or guardian, and on any additional conditions I set for that engagement.
Cancellation, rescheduling, no-shows and refunds for coaching are covered by the Refund & Cancellation Policy.
10. Courses (The Learning Room)
The Learning Room may include free and paid online courses. Some courses may require you to create an account.
- Access to a paid course is for the period stated on the course page. If no period is stated, access lasts for as long as I continue to offer the course, and I will give people enrolled in the course at least 30 days’ notice by email before withdrawing it.
- I may update or improve course content from time to time. I will not remove material in a way that substantially reduces what you paid for.
- Course materials are covered by the licence in clause 5.
- Course content is educational. It is not professional advice (see clause 13).
Refunds for paid courses are covered by the Refund & Cancellation Policy.
11. Live online events (Live Sessions)
Live Sessions may be free or ticketed. Registration may be through this website or a third-party ticketing platform. If you register through a ticketing platform, its terms also apply to the registration process.
- Event details, including date, time (with time zone), platform and price, are shown on the event page.
- I may record a Live Session and make the recording available to attendees or others. I will tell you beforehand if a session will be recorded, and how to keep your camera and microphone off if you prefer not to appear.
- I may remove anyone from a Live Session who is disruptive, abusive or in breach of these terms.
- If I need to change the date or time of an event, I will tell registered attendees as early as I can.
Cancellations and refunds for events are covered by the Refund & Cancellation Policy.
12. Membership (The Owen Magocha Circle)
The Owen Magocha Circle has three tiers:
| Tier | Price |
|---|---|
| Reader | Free |
| Circle | A$9 per month |
| Circle Plus | A$25 per month |
What each tier includes is described on the membership page.
Accounts. Membership accounts are managed through a third-party membership and login provider, the membership provider named at sign-up. You are responsible for keeping your login details secure and for activity on your account. Accounts are personal and must not be shared.
Billing. Paid tiers are monthly subscriptions billed in advance through Stripe Billing. Your subscription renews automatically each month, on the same date as your first payment, until you cancel. Stripe will email a receipt for each payment.
Cancelling. You can cancel at any time through your account or by contacting me. Cancellation takes effect at the end of your current billing period. You keep access until then, and you will not be charged again.
Changing tiers. If you move between tiers, the change and any price difference will be applied as described at the time you make the change.
Price changes. I may change membership prices. I will give you at least 30 days’ notice by email before a new price applies to you. If you do not wish to continue at the new price, you can cancel before it takes effect.
Failed payments. If a payment fails, Stripe may retry it. If payment is not made, I may pause or end your paid access.
A commercial subscription. Membership is a commercial subscription in exchange for access to content and benefits. It is not a donation, a gift or a charitable contribution, and it is not tax-deductible as a gift.
Refunds for membership are covered by the Refund & Cancellation Policy.
13. Not professional advice
The content on this website, including articles, reflections, newsletters, downloads, products, courses, Live Sessions and member content, is general information and personal reflection. It is not legal, immigration, financial, tax, medical, psychological or other professional advice, and it does not take account of your particular circumstances.
Although I am trained in law, nothing on this website creates a lawyer–client or migration agent–client relationship. Before acting on anything that affects your legal, immigration, financial, health or other personal circumstances, get advice from an appropriately qualified professional.
Articles reflect my views at the time of writing. Laws, policies and circumstances change, and older content may not be current.
14. Affiliate links and third-party sites
Some recommended reading and resource links are affiliate links. If you buy through one, I may earn a commission at no extra cost to you. Affiliate links are clearly labelled. See the Affiliate Disclosure.
The website links to third-party websites and services, including payment, booking, video-call, ticketing, membership and retail providers. I do not control those sites and am not responsible for their content, availability or privacy practices. Their own terms and policies apply when you use them.
15. Limitation of liability
This clause is subject to clause 2. Nothing in it limits any liability that cannot lawfully be limited, including under the Australian Consumer Law.
To the extent permitted by law:
- I am not liable for any loss arising from your reliance on general information on the website, or from your decisions and actions after reading content, using a product or attending a session;
- I am not liable for loss caused by events outside my reasonable control, including outages or failures of third-party platforms, internet services or payment systems;
- I am not liable for any indirect or consequential loss, or loss of profit, revenue, opportunity or data, whether arising in contract, negligence or otherwise; and
- where the law allows my liability for a failure to comply with a consumer guarantee to be limited, my liability is limited, at my option, to supplying the goods or services again, or paying the cost of having them supplied again (for services), or replacing or repairing the goods, or paying the cost of doing so (for goods).
My total liability to you for any claim connected with a purchase is limited to the amount you paid for that purchase, to the extent permitted by law.
16. Governing law
These terms are governed by the laws of New South Wales, Australia. You and I submit to the non-exclusive jurisdiction of the courts of New South Wales and the federal courts of Australia sitting in New South Wales.
If you have a concern, please contact me first. I will try to resolve it with you directly and promptly.
17. Changes to these terms
I may update these terms from time to time, for example when I add a new offering or a law changes. The updated version will be posted on this page with a new “last updated” date. Changes will not apply retrospectively to a purchase already made. For an ongoing membership, I will give you at least 30 days’ notice by email of any change that materially affects you, and you may cancel before the change takes effect.
18. General
If any part of these terms is found to be invalid or unenforceable, that part will be read down or severed, and the rest will continue to apply. If I do not enforce a right at a particular time, I have not waived it. You may not transfer your rights under these terms without my consent.
